Before you decide to use English Out Loud SNS, please read through the following terms and agree with them.
This agreement was originally written in English (US). If any translated version of this agreement conflicts with the English version, the English version controls.
A. Definition
“English Out Loud SNS” (“this service”) is a social network service for people learning English as a foreign language to interact with each other. “The terms of service at English Out Loud SNS” (“the terms”)defines the rules in the relationship between the users of this service provided by English Out Loud(“EOL”)and EOL itself. The terms are valid in all the relationships that occur with the use of this service. A user will be considered to have agreed with the terms once the registration of the user is completed. If not agree, he/she may not use the service.
B. Membership
Anyone leaning English as a foreign language is welcome to be a member of EOL. Those who are native in English language can be a member only if the administer approves. A member is to use this service at his/her own risk, and is responsible for the following tasks;
1.saving on his/her own any files or data the member creates
2.preserving his/her password for this service so that no third person will obtain it
3.not violating any copyright, right of portrait, or privacy that belongs to EOL, other members, or third parties.
EOL will be no responsible for any losses caused by violating any of the above.
C. Management of Data
Members accept the fact that the management of the data and the files in this service is not completely secure. In any case of an unexpected accident that may erase some data or files, EOL will not be responsible for the loss.
D. Prohibitions
The following acts are prohibited in this service ;
1. Expression in any other languages than English, except when quoting in English context words or short phrases derived from other languages
2.Illegal act, and any action that suggest, invite or help illegal actions by others
3.any behavior that interferes access or operation by other members
4.any behavior that obstructs operation of the site or the network system
5.any act of ruining reputation, credit of other members, or violating privacy, publicity, copyright and other rights of other members
6.any slanders, threats, offense against other members or other act that may cause mental damage of other members
7.posting expressions that may be associated to discrimination of races, ethnic groups, sex or age
8.posting pornography, nudity, violence or other dirty expression that may offend general public, regardless to the ways of expression such as language or image
9.manipulating or erasing information that belongs to other members or EOL
10. sending or posting information that is not factual
11. posting commercial messages or solicitation without a permission from EOL or an adequate contract with EOL
12.faking identity of a member him/herself
13.collecting or accumulating personal information of other members
14.copying, duplicating, or distributing any data that belongs to other members or EOL
15.other violation against public order and moral, and other behavior that EOL concludes is inadequate
When a member is confirmed to have committed any of the above, EOL will take a necessary action, such as termination of the membership or lawsuit.
E. Privacy
Your privacy is important at this service. EOL is responsible for designing its privacy policy to disclose how you can use this service to share information with others as well as how EOL can use your contents and information. You are encouraged to read the Privacy Policy, and to use it to make informed decisions.
F. Modification of the Terms
Due to enactment, amendment, or repeal of laws and other reasons, EOL holds the right to modify the terms without any permission by the members. The modified terms will be valid when they appear on the site.
G. Exemptions
EOL will not be responsible for any losses to any of the members that may occur from the use of this service. Besides, EOL will not be responsible for any losses or damages caused by its member to a third party, and the member will solve the problem with his/her own responsibility and expenses, without causing any losses to EOL.
H. Discontinuation and Termination of This Service
In order to let the members use this service in a desirable condition, EOL will discontinue it without any advanced notification to the members when any of the following occurs ;
1. need for periodical or emergency maintenance
2. overload on the system
3. a problem that necessitate securing the members or their information
4. incapability of providing this service due to fire, blackout, earthquake, erruption, flood, tsunami or other natural disasters, war, riot, turbulence, or labor dispute
5. other operative or technical problems that necessitate the discontinuation of this service
Also, EOL is able to terminate a part of this service or the whole service on its decision with an advanced notification to the members. In any case of discontinuation or termination of this service, EOL will not be responsible for any losses or damages to the members that may have been caused by that.
I. The Fundamental Law and The Court
Interpretation of the terms is based upon the laws of Japan, and if any lawsuit occurs between a member and EOL, the district court in the local area where EOL is located will have jurisdiction for the first trial.
